Mobile Message Service Terms and Conditions

Genetic Arts Corp’s  mobile message service (the “Service”) is operated by Genetic Arts Corp (“Genetic Arts”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Genetic Arts’ SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Genetic Arts Corp through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

Additionally, by providing your phone number, you consent to receive marketing calls from Genetic Arts Corp, including those made using an autodialer or prerecorded voice. Consent is not required for any purchase. You can opt-out of these marketing calls at any time by following the opt-out instructions provided during the call or contacting our customer support team.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Genetic Arts. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command(s) STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to 62606. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Genetic Arts Corp mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Genetic Arts Corporation may not, and will not, treat you differently because of your Consumer Request or Opt-Out activity. Genetic Arts Corporation may not and will not deny goods or services to you; charge different rates for goods or services; provide a different level quality of goods or services; or suggest any of the preceding will occur. However, we can and may charge you a different rate, or provide a different level of quality, if the difference is reasonably related to the value provided by your personal information. Further, some Service functionality and features may change or become unavailable upon deletion or restriction on use of your personal information.

PROTECTED HEALTH INFORMATION

By setting up an account with Genetic Arts Corp, you are establishing a direct customer relationship with Genetic Arts Corp to use the Service. During your use of the Service, you may provide to Genetic Arts Corp information, including but not limited to, your name, email, social media profiles, date of birth, phone number, address, and transactional information, that we do not consider “protected health information” or “medical information”.

You may also provide to Genetic Arts Corp certain health or medical information protected under applicable laws. Genetic Arts Corp is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments (“HIPAA”). Additionally, the Pharmacies, Medical Groups, and/or Providers of the Service may or may not be a “covered entity” or “business associate” under HIPAA. However, in certain cases, Genetic Arts Corp may be considered a “business associate” of a Pharmacy or Medical Group.

HIPAA may not apply to an entity or person solely due to the involvement of health information, and may also not apply to the transactions and/or communications with Genetic Arts Corp, the Pharmacies, Medical Groups, and/or Providers of the Service. In cases where Genetic Arts Corp is considered a “business associate”, Genetic Arts Corp may be subject to certain provisions of HIPAA with respect to Protected Health Information (“PHI”) that you provide to Genetic Arts Corp, the Pharmacies, Medical Groups, and/or Providers. Furthermore, any medical and/or health information that you provide that is subject to protections under applicable state laws, will be used and disclosed only in accordance with such applicable laws (collectively, “Protected Information”). However, information that does not constitute as Protected Information under applicable laws may be used or disclosed as outlined under this Privacy Policy.

The Pharmacies, Medical Groups, and/or Providers each have their own Privacy Policy notices that dictate how they use and disclose Protected Information. By using the Service, you are acknowledging receipt and confirming that you have read, accept, and adhere to the Privacy Policies of the Pharmacies, Medical Groups, and/or Providers, which may be located on their own respective website(s).

Additionally, by accessing or using the Service, you are acknowledging that if HIPAA does apply to Genetic Arts Corp, the Pharmacies, Medical Groups, and/or Providers, any information that you submit to Genetic Arts Corp, that is not intended and used solely for the provision of diagnosis and treatment, is not considered Protected Information, and will only be subject to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For the avoidance of doubt, information you provide to Genetic Arts Corp to create an account to use the Service, including your name, email, social media profiles, date of both, phone number, address, and transactional information, are not considered Protected Information.

How Long We Keep Your Personal Information

We keep your personal information only for as long as we need to. This time period may depend on what we are using your information for, in accordance with this privacy policy. For example, if you have provided us with personal information as part of creating an account with us, we may retain this information for the duration your account exists on our system. If your personal information is no longer required for this purpose, we will delete it or make it anonymous by removing all details that identify you.

However, if necessary, we may retain your personal information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.
